Acceptable Use Policy
This Acceptable Use Policy ("AUP") applies to everyone who uses Monkey Blast, a service of Monkey Blast LLC. It is part of our Terms of Service. If you do not follow it, we may suspend your account.
1. Why this policy exists
Texting is personal and closely regulated. Carriers, regulators and the people you text all expect messages to be wanted, honest and easy to stop. One sender who breaks the rules can get numbers blocked for everyone. This policy sets the minimum standard for every message sent through Monkey Blast.
2. Consent is required
- You must have the recipient's prior express consent to receive texts from you before you send the first message. For marketing or telemarketing messages, you must have prior express written consent as required by the TCPA and the Florida Telephone Solicitation Act.
- Consent must be specific to you (the business that will text them) and must be clear about what kind of messages they will receive. Consent cannot be a condition of buying anything.
- You must keep records showing when and how each contact gave consent, and give them to us or a carrier on request.
- Consent given to someone else does not transfer to you.
3. Opt outs: honor STOP immediately
- Anyone may opt out at any time by replying STOP or a similar word (such as END, CANCEL, UNSUBSCRIBE or QUIT), or by asking in their own words. You must honor every opt out immediately.
- Monkey Blast suppresses opted out numbers automatically. You must not work around this: do not re-import, re-add or text an opted out contact again unless they opt back in themselves.
- Your first message to a contact must tell them how to opt out (for example "Reply STOP to opt out").
- You must respond to HELP requests with your business name and how to reach you.
4. Quiet hours
You may send texts only between 8:00 AM and 8:00 PM in the recipient's local time. Some states set narrower hours or limit how many messages you may send in a day, and you must follow the stricter rule.
By default, Monkey Blast sends workflows only between 8:30 AM and 7:30 PM in the contact's local time, and never outside 8:00 AM to 8:00 PM. When we do not know a contact's location, we use a default time zone, so keep contact states accurate. It also limits how many texts a contact receives in a day. These protections help, but you remain responsible for when and how often you text.
5. Laws you must follow
You must comply with every law and rule that applies to your messages, including:
- the Telephone Consumer Protection Act (TCPA) and the FCC's rules under it;
- the Florida Telephone Solicitation Act (FTSA) and other state telemarketing and texting laws;
- the National Do Not Call Registry and state do not call lists, where they apply;
- insurance marketing rules that apply to you, including rules for Medicare and other regulated products;
- CTIA guidelines and carrier codes of conduct, and the terms of your number registration.
Messages must match the use case you registered with carriers.
6. No purchased or scraped lists
You may not text contacts from purchased, rented, borrowed, shared or scraped lists, lead lists where consent was not given to you, or numbers generated by any automated means. Uploading such a list is a violation of this policy even if no message has been sent yet.
7. Identify yourself
Your messages must say who is texting (your name or your agency's name) and must not mislead the recipient about who you are, what you are offering or why you are texting. Do not impersonate any person, agency, insurer or government body.
8. Prohibited content
You may not use Monkey Blast to send content involving:
- SHAFT: sex or adult content, hate speech, alcohol, firearms, or tobacco and vaping products (including cannabis and CBD);
- illegal drugs or any illegal product, service or activity;
- gambling, sweepstakes or contests that require payment;
- high risk financial offers, such as payday loans, debt relief or consolidation, credit repair, or cryptocurrency schemes;
- get rich quick, multi level marketing or work from home schemes;
- phishing, fraud, deceptive claims, fake urgency or misleading links;
- harassment, threats, violence or content that is defamatory or invades privacy;
- malware, or links meant to hide where they go (including public link shorteners);
- content that infringes someone else's intellectual property;
- anything carriers prohibit under their current guidelines.
9. Prohibited use of the service
- sending to numbers you do not have consent to text, or sending at volumes or frequencies meant to annoy;
- snowshoeing (spreading sends across numbers to avoid filters) or rotating numbers to evade blocks;
- sharing your account with another business or reselling the service without our written approval;
- interfering with or testing the security of the service, or accessing other customers' data;
- using the service to collect sensitive information such as full Social Security numbers or card numbers by text.
10. Monitoring and enforcement
We may review message content, opt out and complaint rates and consent records to enforce this policy and protect carriers and recipients. If we believe you have violated it, we may, with or without notice: block messages, pause workflows, suspend or close your account, and share information with carriers or authorities as required by law. Serious or repeated violations lead to permanent closure. Fees and usage already incurred are not refunded because of a suspension for violations, and you are responsible for any carrier fines or penalties your messages cause.
11. Reporting abuse
If you received a text through Monkey Blast that you did not agree to, reply STOP to it, then email support@monkeyblast.app so we can investigate. Please include the date of the message and what it said.
